Trust Protector Services
Independence Protects Legacy
In multigenerational trust planning—especially within Private Trust Company structures—independence matters.
A Trust Protector provides the independent oversight necessary to preserve the legal integrity, flexibility, and long-term defensibility of sophisticated family trust structures.
As laws change, trustees evolve, and generations transition, the Trust Protector helps ensure that the trust remains aligned with its original purpose while adapting to future realities.
Properly structured Trust Protector oversight may help:
Preserve fiduciary independence
Protect trust jurisdiction advantages
Strengthen asset protection integrity
Provide continuity across generations
Resolve governance disputes
Remove and replace trustees when necessary
Safeguard long-term family objectives
In Private Trust Company environments, the Trust Protector often serves as the critical balancing mechanism between family stewardship and independent governance.
Daniel G. Worthington was among the drafting team involved in developing the first Trust Protector statute enacted in the United States in South Dakota—helping shape the modern evolution of Trust Protector law and directed trust planning.
At Covenant Legacy Design Group, LLC, we help families and family offices design governance structures built not only to preserve wealth—but to preserve continuity, stability, and legacy across generations.
A Thoughtful Approach to Generational Planning
For more than 35 years, we have advised families on the thoughtful structuring of wealth for long-term stewardship.
Our work focuses on helping families bring order and clarity to complex financial lives—designing structures that are durable, adaptable, and aligned with long-term purpose.
Our role is not to take over—but to guide, structure, and support thoughtful decision-making over time.
What Clients Value
Clients typically come to us at moments when decisions matter—whether simplifying existing structures, preparing for transition, or building a long-term framework for future generations.
They value a steady, experienced perspective—one that balances technical understanding with sound judgment and remains focused on what will endure over time.
Above all, they value clarity.
How We Work
Our role is to advise—not to replace your existing legal, tax, or investment professionals.
We work alongside your advisors to help ensure that structures are not only technically sound, but also practical, well-governed, and capable of serving your family over time.
The focus is always the same: clarity, discipline, and continuity over time.
Where appropriate, we remain engaged as Trust Protector—helping ensure your structures continue to function as intended and adapt thoughtfully over time.
Our Work
Our advisory work typically includes:
• Design of private family trust companies (PTCs) and governance frameworks
• Structuring multi-jurisdictional trust arrangements
• Advising on the role and function of Trust Protectors
• Integrating family governance with legal and financial structures
• Coordinating with legal, tax, and investment advisors to align planning strategiesEach engagement is tailored. There is no standard template—only careful design based on the family’s circumstances and objectives.
Leadership and Experience
The Covenant Legacy Design Group is led by Dr. Daniel G. Worthington, J.D., LL.M., Ed.D., whose career spans legal practice, academic leadership, and national thought leadership in trust and estate planning.
He previously served as associate dean at the University of South Dakota School of Law and, for over two decades, served on the board of the South Dakota Trust Company—widely regarded as a national leader in modern trust administration.
He has consulted with families and multifamily offices for over thirty years. His work has been published nationally on multigenerational trust issues, including contributions to leading professional publications on trust situs, governance, and long-term planning.
Legacy By Design
Legacy by Design reflects more than a philosophy—it is a practical framework developed over decades of advising families navigating complexity, responsibility, and long-term planning.
At its core is a simple idea:
Wealth alone does not sustain a family—structure, purpose, and stewardship do.
The framework brings these elements together, helping families move beyond fragmented planning toward a more integrated, thoughtful approach—one that can endure across generations.
We help families build governance structures that foster a healthy relationship between wealth and responsibility—supporting continuity across generations.
Well-designed trust governance systems
do more than protect wealth
—they prepare people.
Designed for Clarity.
Built for the Long Term.
The principles behind Legacy by Design guide our work
Helping families move beyond fragmented planning toward integrated systems built to endure.
Not just plans—but systems designed to work together for generations.
If these ideas resonate, we’re always happy to begin with a simple, private conversation
